The major components carry the following warranties.

  • Workmanship: 1 year
  • Sunsynk Inverter & Battery combination:  10 years
  • Solar panels: 12-year product & 25-year linear output warranty
  • Mounting structure: 20-year product warranty

 

NOTE: Genergy does not carry the warranty on the equipment, Genergy can facilitate the warranty claim from the manufacturer on behalf of the customer should the need ever arise.  Detailed manufacturer warranty documents are available on request

Payment Terms: 80% Deposit, 20% on Commissioning of System

  1. Payment

    1.1 All amounts shall be paid free of deduction and set off in clear and available funds by electronic funds transfer to the banking account of Genergy.

    1.2 Notwithstanding any dispute between the parties, the customer shall not be entitled to refuse, delay, or withhold payment or any part thereof.

  2. Ownership
    2.1. Genergy will remain the owner of the system and all its components until the customer has paid the project costs in full.

    2.2. The customer will take delivery of the system on the date of commissioning, from which date all benefit and risk in and to the system shall pass to the customer.

  3. Warranties

    3.1. On date of commissioning and handover, Genergy will provide the customer with an electrical certificate of compliance and the warranty certificates for the system.

    3.2. The warranties shall be for the benefit of the customer and are fully transferable and assignable without additional cost.

    3.3. During the 1st 12 months after handover, and thereafter while a valid maintenance agreement is in place, Genergy will handle the warranty process for any components that fail within their warranty period. Any replacement of components that fail out of their warranty will be done at the customer’s costs.

    3.4. If the customer elects not to enter into a maintenance agreement with Genergy after the 1st 12 months from handover, all warranty claims will be the customer’s responsibility.

  4. Indemnity

    The customer shall be solely responsible for and shall hold Genergy fully indemnified against any loss or damage arising to or in connection with the system or because of the use of the system. The customer shall fully and completely indemnify Genergy in respect of all claims by any person whatsoever for injury to person or property caused by or in connection with the use or situation of the system and in respect of all costs and charges in connection therewith except where such claim is because of the gross negligence or wilful default of Genergy.

  5. Limitation of liability

    Genergy shall not be liable for any loss or damage (whether direct, indirect or consequential) suffered by the customer as a result of any act or omission of Genergy, any defects in the system, any act or omission in respect of any services rendered by Genergy or as a result of the negligent use of the system by the customer.   6. Breach

    If any party should breach any material provision of this agreement and fail to remedy such breach within 5 days of receipt of written demand from the other party, the innocent party shall be entitled to cancel this agreement by giving written notice to that effect to the defaulting party. Such cancellation shall be without prejudice to any other remedies the innocent party may have in terms of common law pursuant to such breach and cancellation.

  1. General

    7.1. This agreement contains all the express provisions agreed on by the parties, and the parties waive the right to rely on any alleged provision not expressly contained in this agreement.

    7.2. A party may not rely on any representation which allegedly induced that party to enter into this agreement unless the representation is recorded in this agreement.

    7.3. No indulgence shown by Genergy shall constitute a waiver of any of its rights.

    7.4. No contract varying, adding to, deleting from, or cancelling this agreement, and no waiver of any right under this Agreement, shall be effective unless reduced to writing and signed by or on behalf of the parties.

    7.5. A certificate under the hand of any director of Genergy as to the amount of any indebtedness of the customer shall be prima facie proof of the customer’s indebtedness.

    7.6. This agreement is to be governed, interpreted, and implemented in accordance with the laws of the Republic of South Africa.

    7.7. Any costs, including all legal costs on an attorney and own client basis and VAT, incurred by a party arising out of or in connection with a breach by the other party shall be borne by the party in breach.
